The question is -

My answer:

The ‘criminal’ reference is heavily bloviated but likewise, it doesn’t preclude the possibility of people, the perpetrator of copyright infringing willingly or with knowing conscience, getting handcuffed and landed in, well – jail.

Did I sound spooky?

Well, I am not sure of your perspective on my answer, but let’s face it – everyone enjoyed halcyonic days of torrenting files from KAT (Kickasstorrent), oblivious to the repercussion that came as earth-shattering reality when FBI agents apprehended the owner of the torrent site, in Poland.

It triggered (as assumed so far) chain reaction of closure of web’s oldest torrent-linking site – Torrentz.edu (clueless I am if it is accessible now or replacement of the same by some impostor ones has already happened).

The point is – cyber law enforcement agencies reach at you or not, or how longer you stay unaffected by these obfuscated or mild-warning messages depend entirely on matters of time. However, the possibility of not being detained stands irrefutable. Longer timespan of safety can’t overrule the impending danger of laws arriving at your doorstep.

After reading everyone’s answer, I’ve developed my conclusion about you fellows, that almost all of you act like the pigeon given to the nature of closing eyes at the sight of a cat standing near to her watching hungrily at the bird. You act like the poor bird who visualizes her safety with her belief that by closing eyes to the danger nearby would parry it once for all.

No, it will not. It is a lingering peril. You may fall for it eventually if you’re run out of luck.

Appearance of counterfeit torrenting sites subsequent to the termination of their original version may be tantamount to peace and relaxation for torrent-lechers/seeders, but it is actually NOT the case. Because what you feel like a situation of being over the moon is merely semblance of an ephemeral joy, existence of which is fated to vanish anytime, because it is not LEGIT.

Yeah, agreed that many things in our society are not even close to the definition of what we usually call “legit”, but that’s not point of my discussion. If certain social incidents are illegal, they are addressed by court of laws and perpetrators are jailed subject to culpability of their crimes.

Think from realistic standpoint - torrents and similar file-hosting sites containing copyrighted materials are not AUTHORIZED to sell, or distribute such materials, a trend in vogue generating enormous loss of revenues for the owner of copyrighted materials like movies, books or music, you name it.

What if your own novel is downloaded cost-free from one of the torrent sites?

If I were the movie director and my film were to be released soon, I’d move heaven and earth to ensure my copyrighted film not to be shared/distributed by any unauthorized source (e.g. torrent sites) that would have cost me dear, regardless of whether audiences, later, find my movie good or bad.

So long the movie is in the process of being released and even after that, without my approval, or consent of the distributor, or whoever owns that film legally, the copyrighted material must not be distributed illegally. It is like burgling my house by band of thieves to gain an access to my valuables, thinking they belong to them.

From the viewpoint of an audience, there is entirely different perspective on the same.

Note - My discussion revolves strictly around whether downloading copyrighted materials from torrents is right or wrong from the spectacle of laws. I concur, it is illegal. the perpetrator is framed as criminal depends on his/her nature of involvement into accessing the copyright-protected materials online, as laid out by the Indian law.

Technical Writer. Blogger.

A torrent file is a computer file that contains metadata about files and folders to be distributed through network locations of trackers (please read Wikipedia). Famous sites like KAT (kickasstorrent), Extratorrent and Piratbay allow users download files such as new and old movies, TV shows, music and many other materials, which are copyrighted, and therefore, are expressively forbidden by their respective owners not to be shared or distributed by any third party like torrenting sites. In fact,
