Tentative Patent

When Voltaire once stated that the Holy Roman Empire is neither a Roman nor a Holy nor an empire, people started calling it Provisional Patent Application (PPA). It’s not an exam nor a result nor a kind of patent. These all are misleading talks all over the world which are all nonsense. It is also not Provisional Patent in any case while most of the people in different countries consider it. It’s a form which has to be filled up by the public to provide security to their invention.

Provisional Patent Application is a text file portraying your invention and methods, but it’s not easy and that formal like regular patent application. This application imposes a smaller fee for describing your invention. It’s not absolutely necessary to file a PPA, you can jump to the formal application depending on your will. But the function of PPA is permitting the inventor to demonstrate a former priority date to their ideas. In order to wait till the former priority date, you have to register a formal patent application in order to file the PPA. Without the registration of formal patent application, you will not be permitted for the registration of PPA.

In maximum countries, it doesn’t count the one who have invented it, but it counts the one who files it first. But in countries like US, it provides the opportunity to the first who invented it rather than the first who files it. While the inventor is diligent to pursue the Provisional patent, the person will be listed in the US patent. Perhaps, the inventor refuges to file it first, the result are expected to be pricey, time-consuming and a lot of legal procedures are held including interference proceedings to settle down. As legal procedures take a long duration and time, the other people have to wait until the matter is resolved and resumed.

Therefore in 1995, US inaugurated PPA to provide an opportunity to the inventors a simpler way to fix their priority date, also helping them in acquiring foreign patents. Unlike the formal ones, PPA is not viewed on its merits. And in any condition if you neglect to file PPA within the given 12 months, you miss your priority date resulting nothing.
