You will be shocked to know that employers are really careless about their worker’s working condition and that is the reason according a survey in 2015 alone, injured workers received more than $ 61.9 million in settlements for work related injuries.  So, you can understand that how common are work place accidents. However, in such a situation, it is less likely for the employers to come forward and help the workers. Most of them are less willing.

So, if you have filed for a worker’s compensation claim and are fighting tooth and nail to get the money you need to recover, you are not alone.  All you need is some help from the experienced lawyer.

Here are some of the questions that you must ask the workers compensation lawyer, before they start working on your case.

Is worker’s compensation your primary focus?
It is very normal for the lawyers to practise more than one law, but then say “Jack of all trades, master of none”. Sure the lawyer will do a decent job, but you need to hire a lawyer whose primary focus in workers compensation law as they will be updated with all the laws and having handled cases similar before, it will not be a tough case for them. They will help you get a better settlement.

Are you familiar with cases like mine?
Every workers compensation claim is different, but there are always certain patterns that will help you with your legal counsel represent your case efficiently and they learn these patterns through experience. Ask your attorney, if they have ever represented cases similar to yours and what was the outcome. If they were able to settle the case successfully, you will most likely see the same result.

Keep in mind that there is no guarantee that you will win the settlement you want. Every case is unique and it is impossible to predict the outcome.

Who will handle the case?
Many of the large firms and the lawyers there have assistant with help them manage their caseload, perform research and collect all the necessary information. In most of the cases, the lawyer that you meet for consultation will most likely handle your case.  But in some cases, they may pass it to other associate. This does not mean that they won’t do a great job, but it always helps to know whom you are dealing with and whom to get in touch with if you have any doubt of the case.

The accident was my fault? Is it a problem?
As long as you got injured at the work place while serving your employer, you most likely have a case. Keep in mind that it must happen during the course of your duties. Unless you got injured while working under influence of drugs, alcohol or picked a fight on the floor with a co-worker, you most probably have a case.

Fault and negligence do not prevent you from having a valid claim. You are still injured during the course of your work.
